1. 1. About this website

This website provides information about Brookmont estate, a residential land development by Brookmont.  Land is sold by Brookmont through its sales agent, S & A Cross Pty Ltd (RLA 301254).

1. 2. Information is indicative only

All information on this website, including masterplans, lot details, floorplans, images, elevations, pricing and availability, is provided for general information purposes only and may change without notice.

Pricing is current as at the date stated on the website or in any brochure, and is subject to change.  Availability of lots and packages may change at any time.

Floorplans, images and elevations are illustrative only.  Precise measurements and specifications will be detailed in the drawings provided upon contract signing.  In the event of any discrepancy between information on this website (or in a brochure) and a contract, the terms of the contract will prevail.

Nothing on this website constitutes an offer, invitation to treat or representation that any particular lot or package will be available at the price or on the terms shown.  We recommend that you make your own independent enquiries and obtain independent legal, financial and building advice before entering into any contract.

All content on this website, including text, graphics, logos, images, photographs, plans and software, is owned or licensed to us and is protected by copyright, trade mark and other intellectual property laws.  You may view and download content for your personal, non-commercial use only.  You must not reproduce, distribute, modify or use any content for any other purpose without our prior written consent.

You agree to use this website lawfully and responsibly.  You must not:

• use the website in any way that breaches any applicable law or regulation;
• use the website to transmit any material that is threatening, offensive, defamatory, discriminatory or otherwise objectionable;

Information relating to third parties, including home designs, inclusions, specifications and building services, is provided by the third party and not by Brookmont.  We do not warrant or accept any liability for the accuracy or completeness of information provided by any third party.

• this website and its content are provided on an “as is” basis without any warranty, representation or guarantee of any kind, whether express or implied;
• we do not warrant that the website will be uninterrupted, error-free or free from viruses or other harmful components;
• we exclude all liability for any loss or damage (including indirect or consequential loss, loss of profit or loss of opportunity) arising from or in connection with your use of, or reliance on, this website or its content, except to the extent caused by our negligence or a breach of law by us.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee or right that applies under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any equivalent State or Territory legislation which cannot lawfully be excluded, restricted or modified.

1. 9. Privacy and collection of personal information

We collect personal information through this website, including when you submit an enquiry form, register your interest or correspond with us.  The personal information we collect may include your name, email address, telephone number and any other information you provide.

We collect your personal information for the following purposes:

• to respond to your enquiry and provide information about available lots and packages;
• to facilitate the sale of land or house and land packages;
• to comply with our legal obligations (including identity verification obligations under anti-money laundering laws); and
• to send you updates about the development (where you have consented or would reasonably expect to receive them).

If you do not provide the personal information we request, we may not be able to respond to your enquiry or provide our services to you.

We may disclose your personal information to third party agents or contractors who assist us to carry out our functions and activities, such as our sales agent, builder partners, marketing service providers, identity verification providers and our professional advisers.  We do not ordinarily disclose your personal information to overseas recipients unless we tell you at the time we collect it.

1. 10. Identity verification (Anti-Money Laundering)

From 1 July 2026, Australian laws require real estate professionals to verify the identity of their clients before providing services.  This is similar to the checks your bank performs when you open an account.

If you proceed with, or take steps towards, a purchase through this website, we may ask you to provide:

• proof of identity (for example, a copy of your passport and driver’s licence);
• details of any company, trust or other entity involved in the purchase, including information about who ultimately controls it; and
• in some cases, information about the source of your funds.

We will send you a secure link by SMS or email to upload your documents.  The platform we use is easyAML.  Your information will be kept private and secure in accordance with our Privacy Policy.  Other parties involved in your transaction (such as your conveyancer) may make similar requests separately.

These requirements are imposed by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and are designed to ensure Australia remains a safe and transparent place to do business.

1. 11. Changes to these Terms

We may update these Terms from time to time by posting the revised version on this website.  The “last updated” date at the top of this page will indicate when the most recent changes were made.  Your continued use of the website after any changes constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of South Australia.  You and we submit to the non-exclusive jurisdiction of the courts of South Australia in respect of any dispute arising under or in connection with these Terms.

1. 13. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable, it will be read down to the extent necessary to make it valid, or if that is not possible, severed from these Terms.  The remaining provisions will continue in full force and effect.

1. 14. Entire agreement

These Terms, together with our Disclaimer and Privacy Policy, constitute the entire agreement between you and us regarding your use of this website.
